TERMS & CONDITIONS


Content Responsibility

All site content, including text and multimedia, must be provided by the client before work commences. The client is responsible for backing up all content on their site prior to the start of the project. CodeBiceps is not liable for any loss or damage to existing data.


Custom Work and Ownership

CodeBiceps is not responsible for data entry, web hosting, or custom artwork/graphics unless explicitly agreed upon by both parties. Any artwork, images, or text created by CodeBiceps on behalf of the client remains the property of CodeBiceps and/or its suppliers unless otherwise agreed.


Project Timeline

While CodeBiceps strives to meet estimated delivery times, delays may occur due to unforeseen circumstances such as deployment issues, dependencies, third-party support, development bottlenecks, resource unavailability, or communication delays.


Client Review and Approval

Clients will have the opportunity to review the website’s appearance and content during the design phase and after completion. CodeBiceps will await feedback for 7 days after sharing the work. If no feedback is provided within this period, the work will be deemed automatically accepted and approved by the client.


Copyright and Permissions

The client retains the copyright to any materials they provide and grants CodeBiceps the rights to publish and use such material. The client must obtain permission to use any third-party copyrighted material and agrees to indemnify CodeBiceps against any claims arising from unauthorized use.


Post-Deployment Alterations

CodeBiceps is not responsible for any changes made to the client’s website by the client or third parties after deployment. Such alterations may incur additional charges for resolution.


Cancellation and Payment

If the client cancels the service before completion, a cancellation fee equivalent to the amount of work completed will be charged. Non-payment of the cancellation fee or any overdue amount may result in legal action.


Support and Third-Party Services

After the site launches, one month of free support is provided. Post the first month, support is chargeable according to selected price packages. Free support includes bug fixing and email support but excludes site architecture, rule changes, and add-ons/enhancements. No guarantees are made for third-party services.


Additional Work and Billing

Any additional features or scope changes after wireframe sign-off are subject to a change management process and additional billing. Clients will be informed of any additional charges before work begins.


Liability Limitations

CodeBiceps will exercise reasonable skill and care in providing services but makes no warranties regarding availability, quality, accuracy, or performance. CodeBiceps is not liable for any loss or damage caused by inaccuracies, omissions, delays, errors, or third-party services, except in cases of death or personal injury caused by negligence.


Approvals and Delivery

The project will proceed through various stages, with work on subsequent stages beginning only after sign-off and payment for the previous stage. Upon project completion and final payments, all code and material developed will be transferred to the client, who will then own the code.


Use of Completed Work

CodeBiceps reserves the right to publish and use completed work for marketing purposes unless the client requests otherwise in advance and obtains approval.


Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect. Such provisions will be replaced by mutually acceptable, valid, legal, and enforceable provisions reflecting the original intentions.
